LOTS ARE HELD IN VARIOUS GEOGRAPHICAL LOCATIONS.

BUYERS PREMIUM:

VALUE ADDED TAX (VAT) will be charged at 0% on the Buyer’s Premium(unless otherwise stated)

Purchasers from overseas should note that the VAT on the Buyer’s Premium is not recoverable.

The purchaser will pay a buyer’s premium of 25% [10% on vehicle sales], which will be charged on all lots. The premium & Vat is not negotiable and will be paid by all buyers.

NO OVERSEAS BIDDERS UNLESS APPROVED BY US BEFORE BIDDING.-VAT on Goods Destined for Export:

  • All purchasers intending to export their purchases will be initially charged VAT until satisfactory evidence of export is received by James Auctioneers Ltd (the goods must be exported in accordance with regulations under “Indirect Export”). Where satisfactory evidence is not provided, goods will be subject to UK VAT and no VAT refund will be applicable.

Please ensure all relevant documentation is forwarded to us prior to bidding.

BIDDING:

All bids can be submitted to the vendor prior to the auction closing and reserves can be lowered to match the bid made, in all circumstances all bidders should be aware that any bid made can be accepted and all other terms applicable to the bidder will be applied in due course.

PAYMENT TERMS & DEPOSITS:

All purchases are to be paid in full, no later than 72 hrs. from the auction day closure of midday.

For all invoice amounts of £1000.00 or less, payment can be automatically deducted from the credit card / debit card assigned to the buyers account. Items will then be posted to the buyers account address details as supplied.

For any lots not settled or a clear instruction has been confirmed with the auctioneer we reserve the right to take either of the following actions:

  1. For all lots not paid and removed from James Auctioneers trading locations by the above final payment received date, a levy of £10 per day per lot will be charged and this will be invoiced to the buyer accordingly.
  2. If James auctioneers ltd have not received contact from any successful highest bidder within the above time frame, we as per terms and conditions of the sales are within our rights to charge the client, the full outstanding balance and receipt of this will be sent via email. The lot or lots will be sent via recorded post to credit/debit card address on file with the auction platform. Or Charge a 20% non-refundable deposit/charge until either the full balance has been received+storage fees or as full settlement on unpaid goods.
  3. Pass your outstanding debt to a debt collection agency www.stainternational.com for remuneration of any outstanding invoices and the associated fees attached with this process. Please do not bid if these terms cannot be met.

The Sale of Goods Act 1979 does not apply to any auction conducted by James Auctioneers Limited.

James Auctioneers Ltd reserves the right to refuse registration to any person without giving a reason.

Payment can be made by way of bank transfer (must be CHAPS or Faster Payment, which takes 1 day to process, rather than BACS, which takes 3 days) . Please note that we cannot take credit/debit card payments over the phone, all amounts above this need to be via bacs/bank transfer only.

There is NO cash on site and all items need to be paid PRIOR to collection via the above methods only.

James Auctioneers Ltd reserve the right to request from any bidder a deposit before bidding, deposit payment will be via credit/debit card details as assigned to bidder/buyers registration details and a receipt of this will be sent via email and if deemed appropriate recorded post to credit/debit card address on file.

Ten Day Deadline:

If no payment or arrangement for an outstanding invoice has been received, James Auctioneers London has the option to either pass the debt onto our recovery agents www.stainternational.com or remove the lot entirely from sale. James Auctioneers London reserves the right to organise which option suits the operation of the business.

Collections after auction sale:

All Items are delivery only. Postage is calculated at the cheapest possible via our account with Interlink and Pallet ways depending on the item, there is no collection permitted on this auction.

Only our Postage service is applicable, bidders are not authorised to arrange their own courier/postal service.

Please do not bid if these terms cannot be met.

Postage only auctions:

For all items sent using a courier service, James Auctioneers Ltd are not to be held responsible for any breakages or items lost whilst in transit. It is the responsibility of the purchaser/bidder that any items damaged or lost in transit James auctioneers Ltd are not held responsible to make any claims against couriers or delivery via pallet.

Buyers are advised to seek any additional insurance deemed appropriate beforehand themselves to cover any possible loss.  All Items sent via the postage method are sent at the buyer risk. If additional insurance cover is applied via UPS, a relevant claim can be made. James Auctioneers Ltd are not responsible if the claim subsequently is advised as null & void according to the terms of the insurance claim process.

Any additional fees incurred due to incorrect address details given or no body present to receive goods, James Auctioneers reserves the right to re charge the delivery fee on the final invoice.

James Auctioneers London will endeavour to package all items as deemed suitable but is not to be held responsible for any items mishandled during transit and no claim due to insignificant packaging will be accepted.

Postage costs are not negotiable, any questions regarding multiple lot purchase and combined postage costs need to be sent before bidding.

Please do not bid if these terms cannot be met.

Dispatch times

James Auctioneers London Ltd will endeavour to send all items between 2-5 days after payment has been received, any premium service required i.e.: next day or a service requiring the item to be dispatched sooner, please email us prior to bidding to confirm availability and costs. All enquiries made after the auction closure will be ignored and the normal dispatch times will apply.

Risk:

The bidder / buyer is at risk once the buyer is notified of his successful purchases and is strongly advised to effect insurance at once, irrespective of whether title has passed.

Title does not pass to the purchaser until payment has been received in full.

Computer equipment/software: Due to the Data Protection Act, all software and data will be removed from computers prior to selling. This may include hard drives and any components as deemed appropriate from data safety prior to sale. Prior inspection is encouraged.

Watches & Jewellery items: James Auctioneers Ltd does not guarantee the working order or accuracy of any watches or jewellery sold. Prior inspection is encouraged.

Diamond Lots: All lots are sold as seen.

James Auctioneers London do not offer any kind of refund based on differences in opinion based on, clarity, grade or colour of diamond advertised.  The GIE certification report as assigned to each independent diamond. James Auctioneers will not refund any payment based on other 3rd party opinions. Customers are encouraged to view, take secondary opinions prior to placing any bids to satisfy themselves before purchase.

Refunds on diamond items are only valid if the diamond is subsequently found not to be a genuine example and a full 3rd party written confirmation from a qualified Gem Governing body will be required before we will assess the claim. Upon receipt of any subsequent refund request James Auctioneers reserves the right to seek additional verification on any diamond refund request.

On any diamond sold with a clarity enhanced stone the details of the process are as follows: “What Is The Clarity Enhancement Process?

It is a proprietary process that takes a diamond with a visible imperfection and makes the imperfection invisible or much less visible to the naked eye. The imperfection remains in the diamond but it can no longer be seen. A more technical explanation would be the following:

During the clarity enhancement process we insert a microscopic amount of material into the part of the diamond that contains a feather. This material has the same optical properties as the diamond itself. When light travels from one medium to another, it either changes its course or reflects in a different direction. When light attempts to pass through a non-enhanced diamond that has a feather, the light hits the feather and reflects off in any number of directions. That is why we see the feather, and the diamond doesn’t appear to be clean. With a Clarity Enhanced diamond, the light passes through the natural feather because the material used for the enhancement has the same optical characteristics as the diamond. The beam of light “thinks” it’s still traveling through the same material (diamond) and continues its original course.

Sports Memorabilia items: All items sold with a certificate of authenticity are sold as collectors’ items only and is the responsibility of all bidders to view, verify and confirm to the lots own authenticity. James Auctioneers will endeavour to insure that all items sold with a COA and will take precautions to verify the items authenticity to the best of its ability however we do not guarantee 100% unless we have personally organised in person the autographed items. This will be added to any lot description if this is the case.

Any items found subsequently not to be authentic, James Auctioneers Ltd are not to be held responsible.

CLEARANCE TERMS AND ARRANGEMENTS

The premises will be open from 10:00 to 16:00. Please see specific lots descriptions for clearance arrangements.

For all lots not removed from James Auctioneers trading locations by the above removal date a £10 per day per lot charge will be applied.

PLEASE NOTE: We must remind potential purchasers of the terms and conditions relating to the auction sale and that it is their responsibility to check the suitability or otherwise of lots for the purpose for which they are required. Likewise, parties should satisfy themselves as the functionality and condition of lots. The opportunity to do so is provided on the viewing details as detailed in our terms & conditions and NO allowance or refunds will be made in the event that purchasers subsequently discover that the goods are not suitable for their needs or the functionality/condition is not as expected or anticipated. Potential purchasers who choose not to inspect lots prior to bidding on them do so at their own risk.

The Auctioneer makes every reasonable effort to ensure the accuracy of catalogue descriptions and declare that all statements are made without responsibility and shall not give rise to any action in law for damages. Compensation or rescission of a sale by a purchaser.

Electrical/ Mechanical goods are sold on the strict understanding that these are without warranty or any assurance as to their serviceability or working order.

For items listed as tested this is to verify power as working only and does not verify full functionality of any lot.

All items listed as UNTESTED are sold as seen and any possible faults. Parts missing or functionality is the buyer’s responsibilities to enquire before bidding, under no circumstances will any items been liable for a refund if any of the above are found with any lot listed as untested.

REFUNDS: IN NO CIRCUMSTANCES WILL REFUNDS BE CONSIDERED IF THE GOODS HAVE BEEN REMOVED FROM THE SALE SITE. Any refunds given will only be on items listed as full working order or a new item and would be as a gesture of goodwill rather than acceptance of liability for any faults or defects with lots purchased. We accept no liability for any losses suffered as a consequence of any lots being faulty or defective.

RETURNS: under no circumstances are any items to be returned without prior agreement and written confirmation by James auctioneers, any lots returned to us will be rejected.

All buyers/Bidders are invited to contact us PRIOR to bidding to calculate costs/delivery allocation.

ALL PURCHASE INVOICES WILL BE RAISED USING THE DETAILS PROVIDED AT THE TIME OF REGISTERING TO BID. PLEASE ENSURE THAT YOU REGISTER IN THE NAME OF THE PARTY TO WHOM THE INVOICE IS TO BE ADDRESSED. ANY RE-ADDRESSING OR AMENDING OF INVOICES WILL INCUR AN ADMINISTRATION CHARGE OF £15+VAT.

Any items that require to be redelivered will the original postage cost along with an admin charge of £25.
